1.  General
These General Terms and Conditions (henceforth “GTC”) apply to all purchases made by a customer (henceforth “you/the customer”) through the website www.carmenbasilique.com (henceforth “Website"), owned by Carmen Basilique Sagl, Via Generoso 2, 6900 Lugano (henceforth “Carmen Basilique”).
Carmen Basilique reserves the right to change these GTC at any moment. The GTC applicable to a specific order will be those in force on the date when that order is placed. Opposition to and deviation from these GTC won’t be recognized without prior written approval from Carmen Basilique. By placing an order on the Website, you accept and agree to be bound by these General Terms and Conditions.
 
2.  Conformity of goods
The items sold on this Website are limited to stock availability. If an item is temporarily out of stock, we will send you an email with the estimated delivery date.
All product descriptions, specifications, and pictures on the Website are provided by the suppliers and are for illustration purposes only (i.e., not binding).
The pictures in the catalogue are as real to life as possible but at no time should they be taken as a guarantee that the final product will be identical to the picture, especially as regards color. The pictures and catalogue are therefore not binding.
 
3.  Website and customer registration
When you place an order from our online shop or create an account, you will be asked to register by providing your personal details. It is your responsibility to provide accurate and complete registration details. You are also required to keep your personal registration details confidential and not disclose them to unauthorized third parties. Registration is confirmed immediately after you have provided the information required.

Proven manipulation aimed at obtaining unauthorized benefits at Carmen Basilique’s expense may lead to legal action and denial of access to www.carmenbasilique.com.
Each customer has the right to create one customer account. Carmen Basilique reserves the right to cancel multiple accounts, notify the customer, or amend their personal data.

Carmen Basilique cannot guarantee that the Website, platform, data access, and all services will be available at all times.
We offer free standard shipping to Switzerland and Lichtenstein on orders over €500.

4.  Prices and costs
The prices listed on the Website are in Euro (€). If you are shopping from Switzerland or Lichtenstein, VAT dues are included in the price displayed. If your country of residence is neither Switzerland nor Lichtenstein, the listed prices do not include VAT dues. They do not include shipping fees or the VAT applicable in the customer’s country of residence if this is outside Switzerland and Lichtenstein. Shipping fees are listed under paragraph 7.

Prices may be changed at any time without notice, it being understood that the price displayed to you at checkout is the price you pay. Carmen Basilique reserves the right to retain the ordered goods in case of pricing errors. However, in this event Carmen Basilique shall notify you of the price difference and propose an alternative item.
If the advertised price is clearly a mistake, that price is not binding.

Carmen Basilique may run online promotions and special offers. These are valid only for the dates specified and as long as they are advertised on the Website, and cannot be claimed retrospectively.

Shipping costs are listed under “cart” in the order form, unless the shipping and delivery of one or more items require prior consultation with Carmen Basilique and need to be agreed separately. For further details, see paragraph 7.

5.  Placing an order and closing of the sale
You can buy our products through our online shop at www.carmenbasilique.com and through our Instagram account carmenbasilique. We also accept orders placed by phone or via email. An order is confirmed by clicking on the “Purchase Now” button. When you confirm an order, you also confirm that you accept to be bound by these GTC.
You will receive an email confirming your order, delivery address and/or invoice address.
Carmen Basilique reserves the right to refuse an order without giving any reason.
The risk transfers to the carrier when the goods are handed over.
 
6.  Payments
You can pay for your purchases from Carmen Basilique’s online shop in Euro (EUR).
 
The following payment options are available:

- PayPal
 
Prepayment (bank transfer) is also accepted but you must obtain prior written confirmation from Carmen Basilique via email.
All credit card payments are processed through PayPal. You will be asked to provide your personal details, shipping and delivery address, payment card details, and shipping preferences before confirming your purchase. If you are paying with PayPal, you will be guided through the process of placing an order by a series of instructions. When you use PayPal, you will provide your payment details during your first registration. For the next transactions, you will only need to use your PayPal access details (email address and password). All transfers of personal data are protected with advanced SSL encryption protocols. In stock items are shipped on the next available date. If an item you wish to purchase is temporarily out of stock, we will send you an email with the estimated delivery date.

If you are paying by bank transfer, you will receive a confirmation email once the full amount has been successfully transferred to Carmen Basilique. We will reserve the goods for ten days starting from the date of receiving your written order confirmation (e.g., via email). You will then receive a second notice. If we haven’t received the full amount due within four days from the second notice, your order will be cancelled, and Carmen Basilique won’t be subject to any delivery obligation. Any transaction costs will be charged to you.

7.  Shipping costs and delivery
The goods will be delivered by a carrier nominated by Carmen Basilique. Unless otherwise specified, deliveries are carried out on a DAP (delivered at place) basis to the delivery address provided by the customer (Incoterms 2020). International deliveries (outside Switzerland and Lichtenstein) may be subject to additional costs, which will be charged to the customer. These may include VAT, customs duties, and administrative expenses to get through customs.
Shipping costs will be provided under the “cart” feature for your approval before completing your order. Costs may vary depending on the parcel’s weight, size, and destination.
Carmen Basilique will not provide any kind of assembly or disposal services.

All delivery times listed on the Website are estimated delivery times only. Carmen Basilique will notify you if your delivery is running late but shall not be held accountable in any way for any delays.

If an item is out of stock for longer than six weeks, Carmen Basilique will promptly notify you, suggesting alternative products or a refund.
All products listed in the online shop are available in wholesale quantities. Large orders may require longer delivery times, which can be discussed with Carmen Basilique upon request.

Carmen Basilique delivers to Switzerland, Lichtenstein, and worldwide. Unless otherwise agreed prior to the purchase, additional costs (including but not limited to extra transport expenses, customs fees, and foreign VAT) are charged to the customer.

Carmen Basilique reserves the right to split up large orders and orders over 30Kg in separate shipments. If so, you will be promptly informed.
Shipping costs are calculated during the checkout process. We offer two options: standard delivery and priority delivery to Switzerland/Lichtenstein, and express delivery to the rest of the world.

Deliveries to Switzerland and abroad are normally carried out via private carrier. We offer free standard delivery to Switzerland, Lichtenstein, and the EU for orders over €500. Typically, delivery times to Switzerland and Lichtenstein are 4 days from the date of order confirmation for standard deliveries and 2 days for priority deliveries. Delivery times to European and Extra European countries may vary between 5 and 20 days. Delivery times are estimated and are never guaranteed. Carmen Basilique will not be responsible for any variation in the stated delivery times.

8.  Acceptance and inspection of the goods
You will confirm you have received your goods by signing the delivery note provided by the carrier.
You have the duty to inspect the goods promptly and notify Carmen Basilique within 3 working days about any damage that may fall under Carmen Basilique’s responsibility. If you fail to do so, you will be deemed to have accepted the goods unless there are hidden damages that cannot be detected through the usual means of verification. You must promptly notify Carmen Basilique of any damage you discover after accepting the delivery. If you fail to do so, the goods will be deemed accepted even if damaged.

If a parcel is visibly damaged at the time of delivery, you (or the recipient) must open the parcel in front of the carrier to verify that the items inside are in good condition, and sign “accepted with reserve” on the delivery note. If you (or the recipient of the goods) notice that the items have been damaged during delivery, you can refuse the damaged items and sign “refused/damaged” on the delivery note. You should, if possible, take a photograph the damaged items and/or parcel.
If your goods are damaged during delivery, you must send a justified complaint to Carmen Basilique within three days from delivery.

9.  Warranty
The warranty offered by Carmen Basilique is limited to the return or exchange of the purchased goods, and to refunds. Please note the exceptions listed under paragraphs 8 and 9 of these GTC.

To return any purchased goods to Carmen Basilique, you must first notify us via email at cb@carmenbasilique.com. Your email must include: your order number, a description of the items, and the reason to return them.

Carmen Basilique reserves the right to refuse a return if this hasn’t been notified in advance via email.
You have 14 days to return an item. The item must be in perfect condition, unused, undamaged by you, and in its original packaging. You must pay for return shipping costs, unless differently agreed (see paragraphs 8 and 9).

Please notice that personalized items (e.g., where a specific color or a bespoke marking was requested) and discounted goods will not be refunded. You will be able to cancel orders that include such items up to seven days from the date of receiving the order. Once you have received these items, they will be no longer eligible for return.
 
10.  Personal data protection
 Data protection and customer’s privacy are a priority for Carmen Basilique. Our Privacy Policy is an integral part of these General Terms and Conditions. By accepting these GTC, you also agree to comply with our Privacy Policy. You can read our Privacy Policy at this link.
 
11.  Use of goods purchased from Carmen Basilique
You may use the Website www.carmenbasilique.com and its online shop only for private purposes. Any commercial use of products purchased from Carmen Basilique’s online shop, including resale to third parties, is strictly forbidden.
 
12.  Safeguard clause
If any of the provisions of these GTC are held to be void or unenforceable, all other provisions of these GTC shall remain in full force and effect.
 
13.  Governing law and jurisdiction
These GTC are governed by the laws of Switzerland. The place of jurisdiction is Ticino, Switzerland.
